BAE Systems Land Systems (Munitions and Ordnance) Ltd, which is a company specializing in defence equipment, has been imposed with a fine of £80,000 by Liverpool Crown Court. The fine has come following the death of an employee in an explosion, which occurred at the Lancashire site of the company.

The company was prosecuted by the HSE after employee Lynda Wilkins got killed while working with lead styphnate, which is known to be a dangerous explosive, at the plant. The fatal incident occurred on 2 March 2005.

It could not be found out what exactly caused the explosion, as there were no witnesses. However, an HSE investigation revealed that with proper monitoring and supervision inside the premises the explosion could have been avoided.

The company pleaded guilty to violating Section 2(1) of the Health and Safety at Work etc. Act 1974, as it had failed to implement safe working procedures inside its premises. Liverpool Crown Court ordered the company to pay a heavy fine along with £118,000 as costs. The judgement was given on 14 January 2010.

According to HSE Inspector Colin Hutchinson, there is no doubt that gross negligence by BAE Systems led to the tragic accident. Hutchinson also paid his condolences to the family of the victim. He added that lead styphnate is a highly explosive substance and it ought to be handled with care. He further said that BAE Systems was at fault for not having made proper safety arrangements for monitoring and supervision with regard to handling such a dangerous substance.

Cheltenham Council Prosecuted after Mower Accident

Following an accident involving a ride-on mower, the Health and Safety Executive has cautioned employers about using similar mowers without studying the risks thoroughly.

The accident occurred in 2008, when an employee of Cheltenham Borough Council sustained serious injuries after he fell off a ride-on mower onto a park bench. He suffered several injuries including broken ribs and a compressed lung. He had to undergo a long period of recuperation following the accident.

The Council was found guilty of breaching the Health and Safety at Work Act and Management of Health and Safety at Work Regulations 1999. A fine of £14,000 plus costs, in addition to compensation amounting to £3,000 payable to the injured employee, was imposed by magistrates at Cheltenham Court.

HSE investigators proved that the Council had failed to assess the risks involved in use of the equipment in question. The guidelines for use provided along with the mower clearly stated that the slope on which it was being used at the time of the accident was too steep. Had the instructions been studied and followed properly, the accident could have been prevented. The HSE showed that though previous incidents involving similar mowers had occurred in the recent past, the Council had not paid sufficient heed to the risks posed by such machines. The employee operating the equipment was also not correctly trained in the proper use of the machine.

Investigators from the HSE remarked that such accidents are preventable if care is taken to ensure procedures are followed properly. They reiterated that risk assessments undertaken must cover all aspects of operations along with the location of use and the machine’s advantages and disadvantages. They said that such incidents also highlighted the pressing need for machine operators to be fully trained.
